Tell EPA to Approve E15 Before June 1 Deadline
On October 9th, 2018, President Donald Trump traveled to Council Bluffs, Iowa to declare that his administration was “unleashing the power of E15 to fuel our country all year long.” To follow through on that promise, EPA has issued a draft rule that would allow E15 to be sold year-round across all 50 states. The comment period for this draft rule ends April 29th and then EPA will work to finalize the rule before the June 1st deadline when E15 would otherwise be banned from sale in 2/3 of the country.
The draft rule contains a strong legal defense for why and how EPA is allowing E15 to be sold all year long that should stand up to Big Oil lawsuits. However, the draft rule also contains more than one poison pill that would undermine the Renewable Fuel Standard (RFS) and destroy biofuel demand.

Dear Administrator Wheeler:
Thank you for taking action to follow through on President Trump’s promise to make year-round E15 a reality across the country. I urge you to finalize the positive parts of the proposed rule no later than May 31st to ensure we do not go another summer without access to lower-cost, cleaner-burning E15.
Specifically, we support EPA’s proposed interpretations:
- that fuels containing “at least” 10 percent ethanol satisfy the statutory requirement to receive a one-pound volatility waiver
- that E15 is substantially similar to the fuel, E10, upon which vehicles are certified.
However, there are also some provisions in the proposed rule that would make it more difficult to sell E15 and others that would dramatically undermine the Renewable Fuel Standard (RFS). Specifically, I strongly object to:
- the ban on the use of natural gasoline in E85 when that E85 will be used in an E15 blender pump
- the proposal that forces retailers to sell 100 percent of their RINs each quarter, while allowing refiners to wait out the clock until retailers are so desperate to sell, RINs will be essentially worthless.
It is time for EPA to follow through on President Trump’s promise for year-round E15, but it must not come at the cost of destroying biofuels demand and the effectiveness of the RFS.
